Statutory Rape Defense Attorney in Salisbury
Understanding Statutory Rape Charges in Maryland
Unlike other sex crimes in Maryland, statutory rape often involves two parties who have no criminal intentions. Essentially, you can still break the law without planning to. According to state law, a minor under 16 years old is unable to legally consent to a sexual act with an adult. This means that even if the alleged victim explicitly consented to the sexual act, you may still get convicted as a criminal.
The penalties associated with this offense are similar to the severe consequences the state imposes for many other sex crimes. If you were arrested or accused of statutory rape in Maryland, it is imperative to hire me, an experienced defense lawyer, to have on your side. I am William R. Hall, and I have been successfully handling numerous criminal offenses for more than 20 years. I can thoroughly review your case and determine your available legal options in order to obtain the most favorable result possible.

Consequences of Statutory Rape Charges in Maryland
While Maryland doesn’t have a charge specifically called “statutory rape,” sex or sexual acts involving a minor under 16 years old fall under one of three separate classifications for sex offenses. The type of criminal charge is determined by the ages of both parties involved in the offense, as well as the sexual acts entailed.
- Second degree sexual offense: If a sexual act – including vaginal intercourse – occurs between a minor under 14 years of age and an individual at least four years older, the older person can face a maximum prison sentence of 20 years.
- Third degree sexual offense: If a sexual act – including vaginal intercourse – occurs between an individual aged 14 or 15 and an adult over 21 years old, the adult could face a maximum prison sentence of 10 years.
- Fourth degree sexual offense: If a sexual act – including vaginal intercourse – occurs between an individual aged 14 or 15 and an adult who is at least four years older, the adult could face up to 1 year in prison and a maximum $1,000 fine.
Those who are convicted of a second or subsequent offense involving sex with an underage child may be sentenced to life imprisonment.
- Teachers or school employees who engage in sexual acts with students can be sentenced to a maximum jail sentence of one year. Second convictions are punishable by a maximum prison sentence of three years.
