Let Our Salisbury DWI Lawyer Help

DWI charges can lead to some severe consequences, such as jail time, substantial fines, and loss of your driver’s license. When a police officer suspects you of being under the influence of drugs or alcohol, he or she may conduct a run of several field sobriety tests to determine your level of inebriation. If you’re facing a DWI charge, contact our skilled Salisbury DWI attorney as soon as possible. Our experienced criminal defense lawyer comes highly rated and is dedicated to protecting your rights and freedom.

Get started on your case by calling us at (410) 205-1684 or filling out our online form today.

Types of Field Sobriety Tests

The three most common types of field sobriety tests are the Horizontal Gaze Nystagmus (HGN) test, the One-Leg Stand (OLS) test, and the Walk and Turn (W&T) test. These tests are all voluntary. Those suspected of a DWI do not have to perform any of the field sobriety tests; they are mainly used to provide evidence, or probable cause, for a police officer to arrest a person for a DWI and ask him or her to do a breath test at the police station.

Standardization of Field Sobriety Tests

There is a right and a wrong way to conduct a field sobriety test. The National Highway Traffic Safety Administration (NHTSA) publishes a manual and conducts training and certification courses for law enforcement in how to properly administer these tests. If an officer doesn’t conduct the test in a proper manner, the test results could be considered invalid and cannot be considered evidence of impairment.
