Maryland House Bill 105 Impacts DUI Laws

Maryland House Bill 105, set to take effect in 2024, marks a significant shift in DUI laws. The bill mandates the use of an Ignition Interlock Device (IID) for all individuals convicted of alcohol-related driving offenses, even if they were granted probation before judgment (PBJ). An IID, a breathalyzer installed in a vehicle, prevents the car from starting if the driver’s blood alcohol concentration is above a set limit. This expansion targets both first-time and repeat offenders, aiming to reduce alcohol-related accidents and improve road safety throughout Maryland.

In addition to the IID requirement, the bill offers potential relief for those who received a PBJ for DUI/DWI offenses more than 15 years ago. If these individuals successfully completed their probation, they may now be eligible for expungement, allowing them to clear their records.
